Overtime & Minimum Wage Law
Off The Clock Work
Off the clock work is work which is performed by the employee, but which is not recorded by the employer as time worked. The most common examples of off the clock work is work performed by employees at home during weekend or non-business hours. However, it is still not uncommon for some employers to order their workers to "punch out" and go back to work. Any off the clock work by non-exempt workers must be recorded by the employer, and, if including these off the clock hours the employee worked overtime, it must pay overtime wages for these work hours.
