Waiver Of Rights To Minimum Wage And Overtime
It is not uncommon for employers to simply tell workers that they do not pay overtime and only pay straight salary. This is a violation of the FLSA, as workers are not permitted under the law to waive these rights, as this would "nullify the purposes" of the statute. This is true even where the employee signs an agreement that he/she is not entitled to overtime and agrees to work for a salary. Barrentine v.
